Flathead County, MT — July 15, 2025 — This morning, Tuesday, July 15, 2025, the Flathead
County Commission approved a formal Interlocal Agreement with the Montana Department of
Corrections (DOC), marking a significant milestone in the development of the new State-
operated Flathead County Pre-Release Center.
The agreement exceeds the Conditional Use Permit (CUP) requirements recommended by the
Flathead County Board of Adjustment. While the Board of Adjustments initially called for a
Memorandum of Agreement (MOA), the County opted to pursue a more robust, legally binding
Interlocal Agreement—providing stronger oversight and accountability.
The Interlocal Agreement, executed under Montana Code Annotated §7-11-101 et seq., is
designed to support the successful reintegration of formerly incarcerated individuals. The
program will now include specific performance metrics, including recidivism rates, placement
outcomes, and community impact data.
“The Department of Corrections didn’t have to, but they came to the table and negotiated with
us. We secured some critical concessions that matter deeply to our community,” said
Commissioner Randy Brodehl.
One key provision of the agreement is a built-in reporting requirement. The DOC must provide
regular updates to the County, allowing for ongoing oversight and ensuring transparency for the
public.
The Commission approved the agreement in a 2–1 vote. Commissioner Pam Holmquist cast the
dissenting vote, citing concerns about the facility’s location.
“I appreciate everyone’s work on this,” said Holmquist. “The DOC did step up with an Interlocal
instead of an MOA. But while I think this is a great thing, I still believe this is the wrong location
for this facility. I hope they prove me wrong and live up to the terms of this interlocal.”
Flathead County’s approval of the Interlocal Agreement underscores its commitment to public
safety and responsible reintegration efforts.
