LEGAL NOTICE
On Wednesday, March 12, 2025, at 3:30 pm, the Lake County Board of Adjustment will hold a
public hearing in the large conference room (Room 316) of the Lake County Courthouse. The
options for attendance are through ZOOM* or in person. The hearing will include the following
items:
EAGLES NEST TRUST VARIANCE AND CONDITIONAL USE REQUEST
Robert Smith of A2Z Engineering, on behalf of Steve Aguilar of Eagles Nest Trust, is requesting
a variance approval to be within the 50-foot orchard setback and conditional use approval to
exceed impervious surface coverage between 30-49%. The request is associated with the
construction of a dry shop and an addition to a single-family residence in the East Shore Zoning
District. The +/-3.109-acre parcel is located at 19731 MT Hwy 35 and is legally described as lot
13 of Flathead Lakeshore Tracts, section 8, T25N, R19W.
THOMAS CONDITIONAL USE REQUEST
Seth Thomas, on behalf of Misty Thomas, is requesting a conditional use approval to allow for a
home occupation. The request is associated with an existing cannabis grow operation within an
existing building in the Swan Sites Zoning District. The +/-4.381-acre parcel is located at 12635
MT Hwy 83, Bigfork and is legally described as lot 1A on the amended plat of lot 1 of Swan
Sites No. 3, section 12, T26N, R19W.
MALM CONDITIONAL USE REQUEST
Jeffrey S. Malm, DBA Malm Construction MT is requesting conditional use approval to allow
for impervious surface coverage to exceed 26% of the buildable area of a lot. The request is
associated with construction of a single-family residence with attached garage and driveway. The
+/-.50-acre subject property is located at 34250 Stone Wall Dr, within the Stone Ridge Estates
Zoning District and is legally described as lot 26 of Stone Wall Estates Phase II, amended
subdivision plat of lots 26 through 30, a subdivision located in section 31, T23N, R20W.
SYBERT CONDITIONAL USE REQUEST
Tiffany Sybert is requesting conditional use approval to allow for an industrial use for processing
local fruit. The request is associated with an on-site fruit processing facility at Cherrywood
Orchard LLC in the East Shore Zoning District. The +/-8-acre parcel is located at 23320 MT
Hwy 35, Bigfork and is legally described as a portion of lot 12 of Bear Dance Orchard Tracts
section 33, T25N, R19W.
